1.scope

The following general terms and conditions apply to all orders placed via our website. The offer on this website is aimed exclusively at consumers (hereinafter "customer").

A consumer is a natural person who maintains business relationships with SWIPE Fashion who can neither be assigned to their commercial nor their independent professional activity. Orders in non-household quantities can be rejected without justification.

SWIPE Fashion reserves the right to change these terms and conditions at any time. The version of these terms and conditions applicable at the time of the order is decisive, which cannot be unilaterally changed for this order. Conditions of the customer that conflict with or deviate from these GTC are not recognized.

Unless otherwise provided, any shipping costs will be charged additionally and must be paid by the customer. Shipping costs are shown separately in the ordering process.

Technical changes, errors and misprints are reserved, in particular SWIPE Fashion can make price changes at any time and without prior notice. Consulting and support services are not included in the sales prices.

4.Conclusion of contract

The products and prices on this website are non-binding offers.

With the order via this website including the acceptance of these terms and conditions, the customer makes a legally binding offer to conclude the contract. SWIPE Fashion then sends an automatic order confirmation via email, which confirms that the customer's offer has been received by SWIPE Fashion. Orders placed are binding for the customer. Unless otherwise noted, there is no right of return or withdrawal.

The contract is concluded as soon as SWIPE Fashion sends a declaration of acceptance by email confirming the dispatch of the ordered products or services.

Orders are only delivered after full payment has been received (exception: delivery against invoice) and if the goods are available. If it turns out that the ordered goods cannot be delivered or cannot be delivered in full, SWIPE Fashion is entitled not to accept or only partially execute the order. In such a case, SWIPE Fashion will inform the customer by email. If the customer's payment has already been received by SWIPE Fashion, the payment will be refunded to the customer. If no payment has been made, the customer is released from the obligation to pay.

5.Payment options and retention of title

The payment options specified in the ordering process are available to the customer.

SWIPE Fashion reserves the right to exclude customers from individual payment options without giving reasons or to insist on prepayment.

If the customer is late in payment, SWIPE Fashion can charge default interest of 5% per year and a reminder fee of up to CHF 20 per reminder.

The products delivered to the customer remain the property of SWIPE Fashion until full payment.

6.Delivery, inspection obligation, notice of defects and return

Deliveries are sent by post or courier to the address specified by the customer in the order.

SWIPE Fashion endeavors to keep delivery times as short as possible. Any delivery times specified in the order confirmation are non-binding. SWIPE Fashion is entitled to make partial deliveries. In this case, the shipping costs are charged to the customer only once.

The invoice will be sent, if delivery against invoice is offered, at the option of SWIPE Fashion by email or by post.

If the delivery is undeliverable or if the customer refuses to accept the delivery, SWIPE Fashion can terminate the contract after notifying the customer by email and observing a reasonable grace period, and can invoice the costs for the activities.

The customer is obliged to check the delivered goods immediately after receipt of the delivery and to report any defects, for which SWIPE Fashion guarantees, immediately in writing by letter or email to the address in the imprint info@swipe-fashion.com

Returns to SWIPE Fashion are made at the expense and risk of the customer. The customer has to send the goods in their original packaging, complete with all accessories and together with the delivery note and a detailed description of the defects, to the return address given by SWIPE Fashion

If the inspection by SWIPE Fashion reveals that the goods have no detectable defects or that they are not covered by the manufacturer's guarantee, SWIPE Fashion can invoice the customer for the activities, the return or any disposal.

7.Right of withdrawal

The customer is granted a right of withdrawal during 10 calendar days after receipt of the goods. The deadline is considered met if the customer sends the written revocation to SWIPE Fashion by email or letter (address according to www.swipe-fashion.com) within the deadline. The revocation does not require justification.

Exercising the right of withdrawal will result in the contract being reversed. The customer must return the goods in their original packaging within 10 calendar days, complete with all accessories and together with the delivery note, to the return address specified by SWIPE Fashion in the imprint www.swipe-fashion.com. Returns to SWIPE Fashion are made at the expense and risk of the customer. Any payment already made will be refunded to the customer within 20 calendar days if SWIPE Fashion has already received the goods back or the customer can provide proof of shipment.

SWIPE Fashion reserves the right to demand appropriate compensation for damage, excessive wear or loss of value due to improper handling and to deduct the impairment from the purchase price already paid or to invoice the customer.

No right of withdrawal is granted in the following cases:

If the contract has a random element, especially because the price is subject to fluctuations over which the provider has no influence;
If the contract relates to a movable object which, due to its nature, is not suitable for a return or can spoil quickly;
If the contract relates to a movable object that is made according to the customer's specifications or is clearly tailored to personal needs;
If the contract deals with digital content and this content is not made available on a fixed data carrier or if the contract is to be completely fulfilled by both contracting parties immediately;
If the contract concerns a service and the contract has to be completely fulfilled by the provider with the prior express consent of the customer before the cancellation period has expired.
In the areas of accommodation, transport, delivery of food and beverages and leisure activities, if the provider undertakes at the time of signing the contract to provide the services at a specific time or within a precisely specified period.

8.Warranty

SWIPE Fashion strives to deliver goods of impeccable quality. In the event of defects notified in good time, SWIPE Fashion assumes the guarantee for the defect-free nature and functionality of the item purchased by the customer during the statutory warranty period of generally two years from the delivery date. It is at the discretion of SWIPE Fashion to provide the guarantee by free repair, equivalent replacement or by reimbursement of the purchase price. Further warranty rights are excluded.

The warranty does not cover normal wear and tear, the consequences of improper handling or damage by the customer or third parties, or defects that can be attributed to external circumstances. The warranty for consumables and wear parts (e.g. batteries, rechargeable batteries, etc.) is also excluded.

SWIPE Fashion it is not possible to make assurances or guarantees for the topicality, completeness and correctness of the data as well as for the constant or undisturbed availability of the website, its functionalities, integrated hyperlinks and other content. In particular, it is neither guaranteed nor guaranteed that the use of the website will not violate any rights of third parties that are not owned by SWIPE Fashion

9.liability

SWIPE Fashion excludes any liability, regardless of its legal basis, as well as claims for damages against SWIPE Fashion and against any auxiliary persons and vicarious agents. SWIPE Fashion is in particular not liable for indirect damage and consequential damage, loss of profit or other personal, property and pure financial loss of the customer. A further mandatory legal liability is reserved, for example for gross negligence or unlawful intent.

10.privacy
